Las Vegas personal injury lawyer, Donald C. Kudler, of the law firm Cap & Kudler, has settled a case on behalf of his clients who were victims in an injury car accident near Cheyenne and Civic Center. The clients were traveling east on Cheyenne in the middle lane and stopped for the light at Civic Center when they were rear ended by another driver in a Chevrolet Silverado.
The adult client suffered injuries to her neck, low back and shoulders in the accident. Her child, a minor, suffered neck injuries and frontal headaches from the accident. They received care for their personal injuries caused by the other driver’s negligence from Daniel Ragusa, D.C. of Advanced Neck and Back Care. Dr. Ragusa helped both mother and daughter to recover from the injuries caused by the personal injury accident.
The Settlement
We were able to settle the case within the other driver’s policy limits with sufficient funds to compensate the chiropractor, our office and our clients. As required by NRS 41.200, the minor’s portion of the settlement was placed into a blocked trust account for her benefit. NRS 41.200 requires the court to approve a minor child’s settlement and to enter an order that the child’s settlement must be placed in a FDIC insured bank account in the state of Nevada, until the minor child reaches the age of 18 years. These funds can only be removed from the block account by court order. The court will only order the release of these funds before the child turns 18 years of age, only for reasons involving the special educational or medical needs of the minor child.
