Las Vegas Personal Injury Lawyers, Cap and Kudler, have settled a case on behalf of their client who was injured in a car accident while driving south on Rainbow Blvd. The other driver pulled out in to our client’s path when he made a left out of a parking lot to make a left to go north on Rainbow. The law in Nevada is that “the driver of a vehicle about to enter or cross a highway from a private way shall yield the right-of-way to all vehicles approaching on such highway. See, NRS 484B.260. The violation of a traffic which results in injury to another driver or damage to property, such as the case is here is negligence per se. What that means in this case is that the violation of the law in this case is proof that the Defendant was negligent. There was no evidence in this case that the client did anything wrong that contributed to the accident making the other driver 100% at fault for the damages he caused.
Our client’s rare vintage car was severely damaged in the accident. We have to give credit to AAA Insurance in this case for coming to bat and fully compensating the client for the damage to his rare car. They did a complete investigation and looked at all of the facts before making a fair offer for those damages.
Client Injuries
The client’s neck, back and left shoulder were injured as a result of the car accident. He also suffered headaches. He was treated at Centennial Hills Hospital & Medical Center and Advanced Neck & Back Care for the accident. Those providers helped him recover from the injuries caused by the personal injury accident.
Unfortunately, the amount of compensation available to the client was limited since the other driver carried minimum policy limits and our client was not covered by Medical Payments Coverage or Under Insured Motorist Coverage. We worked with the providers to reduce the amounts owed in order to allow the client some measure of compensation. While he was not fully compensated, the reductions given by this office and the providers allowed him to pay for all of the treatment caused by the accident and be somewhat compensated for the pain and suffering experienced as a result of the accident.
